Your right to request records
The Promotion of Access to Information Act 2 of 2000 (PAIA) gives you the right to request access to records held by private bodies, including law firms, where the record is required for the exercise or protection of rights, subject to the Act's grounds of refusal.
How to make a request
- Direct requests to the Information Officer: The Director, Lesiba Kabelo Leshilo, reception@leshiloattorneys.com, or by post/delivery to 11 Rabe Street, Corner President Paul Kruger Street, Polokwane Central, Polokwane, 0700.
- Use the prescribed request form (Form 2) published by the Information Regulator, and describe the record clearly.
- Prescribed fees may apply as set out in the PAIA regulations.
- We respond within the periods PAIA prescribes. If a request is refused, reasons and the grounds relied on are provided, and the Act's remedies — including complaint to the Information Regulator — are available to you.
The firm's PAIA manual
The firm maintains PAIA materials in accordance with the Act and the Information Regulator's requirements. A copy of the firm's PAIA manual is available from the Information Officer on request at the contact details above, and prescribed forms and guidance are published by the Information Regulator (South Africa) at inforegulator.org.za.
A note on privilege and client confidentiality
Attorneys' records are subject to legal professional privilege and duties of confidentiality. PAIA's grounds of refusal protect privileged and clients' confidential records; a PAIA request cannot be used to see other clients' information.
POPIA data-subject requests
If what you actually want is your own personal information — access, correction or deletion — the simpler route is a POPIA request to the Information Officer, as described in the privacy notice.
